Raw Nut Gaming Ltd Terms of Use

The website www.FinalRunner.com (and any future associated FR-branded websites, mobile and tablet apps, FaceBook page and Twitter page) is owned, controlled and operated by Raw Nut Gaming Ltd (RNG), which is a UK-registered company regulated by the UK Gambling Commission.

Definitions:

‘RNG’ refers to the ownership group Raw Nut Gaming Ltd.

‘FR’ refers to www.FinalRunner.com and www.FinalRunner.co.uk.

‘T&Cs’ refers to the following Terms & Conditions within which website rules are strictly bound.

‘User’ refers to anyone visiting FR or holding an account with FR, whether that be an individual or someone managing an organisation's FinalRunner account.

‘FR Services’ refers to any services offered by FinalRunner (including www.finalrunner.com and www.finalrunner.co.uk) and any future associated FinalRunner-branded websites, mobile and tablet apps, and all social media pages including but not limited to Facebook, Twitter, LinkedIn and Google Plus. This also refers to any communication, media, and information published/created by FinalRunner.

‘Terms of Use’ refers to the Terms & Conditions, Privacy Policy, Cookie Policy, Rules of Entry, and all other Terms, Rules and Policies stated on the FR website as applicable to competitions, promotions, features, special offers or any other aspect of your use of FR Services.

‘Organisations’ refers to any organisation (business, charity, social club, community organisation, sports clubs, etc) that registers or has applied to register with FR.

‘Private Competitions’ refers to any Private competition created on FR by a registered User.

Terms & Conditions:

By registering with and/or navigating FR, the user is agreeing to be bound by the following Terms & Conditions, by which procedures, complaints and disputes shall be managed and implicated.   1. Use of FR Services
    1. By visiting, registering and/or using FR Services, the User agrees to be bound by the T&Cs stated as well as all Terms of Use, and has full responsibility to read any updates to the Terms of Use that RNG may send by email before betting with FR.
    2. The User confirms to being eighteen years of age of age or over, and that they are not a person barred from receiving services under the laws of any applicable jurisdiction. In the case of a company or other user that is not an individual, the User agrees that they have the capacity to enter into a contract with RNG.
    3. Any contracts/agreements concluded by RNG shall be in the English language.
    4. In using or registering with FR, the User agrees to be bound by the following:
      1. Information provided about the User is true, accurate and complete to the best of their knowledge, and that any incorrect information is updated with RNG as soon as possible, with consequences of such time delay not attributable whatsoever to RNG.
      2. Barring any payment card details, any registration details provided/FR activity by the User shall be stored by RNG for a minimum period of six years.
      3. FR reserves the right to refuse registration or suspend indefinitely the account of any user at its absolute discretion and without reason.
      4. RNG shall not take any responsibility or accept any liability with regards to the activities of the User registered with or using FR.
      5. All records of communication methods between the User and FR, including but not limited to email, phone and direct messaging, shall be retained by FR up to a maximum of 6 years, to assist in solving complaints, disputed and issues. This includes customer navigation on FR.
    5. The User should discontinue all use of FR and FR Services if not in agreeance with the Terms of Use.
  2. Fees, Payments & Winnings
    1. Competition entry fees paid by Users will be subject to an administrative fee of 15% paid to RNG. Use of the Buy Back feature (refer to section 25.3) will also be subject to the same administrative fee.
    2. The entry fee stake required to enter any competition using FR will range from five pounds (GBP) to five hundred pounds (GBP).
    3. Once any organisation competition begins on FR, the funds reserved by RNG will be paid to the organisation by bank transfer or cheque within a reasonable time after the level of funds to be transferred is determined, and using the payment method chosen by RNG. RNG reserves the right to withhold payment until further investigation if activity is deemed suspicious and not, as agreed to when signing up with FR, acceptable within the bounds of the Terms of Use.
    4. If a competition start deadline is reached with less than six player entries, FR will refund the User's full competition payment to their E-Wallets within a reasonable time after the competition start deadline has passed.
    5. If a User is paid winnings from a competition which they didn't actually win, FR reserves the right to withdraw the amount from the User's E-Wallet.
    6. If the User withdraws funds referred to in T&C Section 2.5 to their bank account before FR can deduct the amount from their E-Wallet, FR reserves the right to immediately request the full amount of the funds owed from the User via bank transfer. If refused, RNG reserves the right to suspend or permantly ban the User’s account because this is deemed as gross misconduct.
    7. FR reserves the right to cancel payment of winnings to a User if they are deemed to have collaborated with others or to have used any other method to manipulate the competition outcome.
    8. On withdrawal of funds from their E-Wallet, the User’s bank will normally be credited within ten working days, although this may be delayed in circumstances outside of FR’s control, which includes but is not limited to website failure.
    9. The User is subject to a maximum daily betting limit, across all competitions entered, of three hundred pounds (GBP).
    10. Customer funds will be held in a segregated account by RNG, so as to assure that in the event of insolvency, customer funds are protected.
    11. Users may not withdraw any money from FR until compulsory Age Verification checks have been completed. If Age Verification is not complete within 72 (seventy two) hours of a User registering with FR, the User’s account will be frozen and no gambling will be allowed on FR until the necessary checks have been completed.
    12. Free entry competitions - only players who have picked winning selections throughout the competition will receive a payout. If a free entry game results in more than one winner for any reason other than the activation of the split pot feature by all remaining players, there will be no payout but FR may choose to compensate players in special circumstances out of their control.
    13. If a User is found to be under the age of eighteen years of age, all deposits shall be refunded back to them by RNG as soon as possible, but no winnings shall be paid in any circumstance. Subsequently, their account will be closed.
  3. Organisations
    1. The person that registers an Organisation is agreeing:
      1. That they represent that Organisation and that they are eighteen years of age or above.
      2. That they are the organisation administrator for the Organisation’s account on FR.
      3. That they must be able to prove, by receipt or other proof deemed acceptable by FR, how they have used funds raised using FR, if requested so by RNG.
      4. That any claims made regarding use of funds from a competition they have organised, will be carried out to that exact description, and if not they will be solely responsible for it, both financially and otherwise. In such case where RNG deems that this rule has been broken, RNG have the right to request that the related funds be given back to RNG, and the use of such funds is at RNG’s complete discretion.
      5. That the organisation's contact details will be made available to Users who wish to make a dispute regarding a competition organised by them.
      6. That the responsibility for paying competition winners the money/services owed falls on them if they have made available a fixed cash prize, a prize, or cash & bonus when creating a competition. Any User disputes regarding non-delivery of money/goods/services from the organisation falls solely on the organisation and their FR account manager. FR reserves the right to suspend or permanently delete an organisation account if actions are deemed gross misconduct by RNG.
      7. To inform the organisation's relevant officers that they have registered the company with FR in order to raise funds. The person accepts full responsibility for legitimate promotion of competitions organised on FR, and agrees to assist with any investigation into the use of funds raised by the organisation using an account with FR.
      8. When promoting FR competitions to players and potential FR Users, it is the person's full responsibility to avoid promoting to those under the age of eighteen years, and also to avoid anyone they believe/know has a gambling addiction. The person is responsible if either of these types are brought to the site because it is a gross infringement of the law and the Gambling Commission. This may lead to a suspension or permanent account closure for the person and/or organisation if RNG deems necessary.
      9. FR performs checks both before an organisation registers and the necessary due diligence subsequent to the conclusion of any of their competitions for peace of mind for Users. If the organisation's FR account manager notices or is involved in practices deemed unethical/illegal by FR, RNG reserves the right to suspend or permanently delete their FR account.
      10. It is the organisation account holder's full responsibility to act in the best interests of the organisation to which the account belongs. This includes prizes offered, delivery of prize and use of funds raised.
    2. RNG can amend competition start dates if reasons are deemed necessary. If a User would like the start date changed, they must send an email requesting so to info@finalrunner.com.
    3. FR will make contact with the Organisation after they have registered with FR, for fraud prevention purposes. Until the organisation is verified (FR will attempt to have checks completed within 72 hours of the organisation registering with FR), the organisation cannot create a competition which has a start date within 72 (seventy two) hours of organisation registration. However, they can create a competition that has a start date a minimum of 72 (seventy two) hours after they have registered with FR if organisation verification checks are completed by then.
    4. When deciding which features the competition organiser wants to incorporate when creating a competition, the following apply:
      1. The features that are available to incorporate are bound by T&Cs Section 25.
      2. The 'Buy Back' feature is always available for inclusion in a competition when it is being created. The 'Split pot' feature is available for inclusion in all competitions whereby the winners' prize does not include something other than cash.
      3. Of the remaining features (‘double chance’, ‘draw no lose’, ‘sympathy loser’), the competition organiser may only select up to one of these in any one competition.
      4. For clarity, the maximum number of features that can be applied to a competition is three, which would include buy back split pot and one of the remaining three features. All features are optional, so a competition can be created with FR without selecting any of the available features.
    5. If a competition reaches its join deadline with less than the minimum required six entries for it to begin, it will be cancelled by RNG, with any entry fees fully refunded to competition entrants.
    6. If RNG assists an organisation to register with the FR website after requested assistance, the organisation must confirm details entered are correct by replying to an email sent by FR, before they can create competitions on FR.
    7. If an Organisation is offering a non-cash prize in a competition they create, they have the ability to amend the prize before or during the competition, but the following apply in this case:
      1. FR accepts their reason for amendment of prize.
      2. FR believes that the new prize offered is of sufficient financial or other value to players, as was the original prize being offered.
      3. FR must agree to the replacement prize being sufficiently beneficial as the prize originally offered before it can be officially changed on the competition page. FR reserves the right to refuse a proposed replacement prize if it is deemed to fall short of the original prize on offer, whether that be financial or otherwise, by RNG.
      4. If FR is not happy with all covered in T&Cs Section 3.8, the Organisation must either amend the prize as instructed by FR or risk the competition being closed down, in which case all player entry fees for the competition will be returned to the respective Users and the Organisation must return all funds received from FR as a result of the competition in question.
      5. In the event of a competition offering some sort of prize, whether that be a product or service, the competition must be played out until there is only one winner. If a season come to an end while such a competition has more than one player remaining, the competition will continue when the league re-starts. FR reserves the right to change prize to another of value deemed equal by RNG or to an equal monetary amount as deemed by RNG.
  4. Private Competitions
    1. To enter private competitions players must enter a unique code provided by the competition creator. The code is issued in step 3 of the competition creation process and can be entered on the player dashboard in the ‘private competition entry code' box. It is players' responsibility to check the competition aspects, including entry fee and that they have accessed the competition intended, before they confirm competition entry.

  5. FR Competitions
    1. Only FR can create free entry competitions. Promo codes can be obtained from FR special events, the User dashboard, via an FR email, or otherwise.
    2. FR reserves the right to withdraw an offered prize if deemed necessary. In the event of such, the cash value of the prize, as deemed by RNG, will be made available as the winnings for the competition winner. Alternatively, FR may decide to replace the prize with a different prize of similar value, as deemed by RNG.
    3. FR reserves the right to cancel any competition, whether it be before it begins or in progress. Entry fees will be returned to players unless FR deems there was any form of gross misconduct, in which case RNG reserves the right to withhold funds until further investigation.
  6. Payment Methods
    1. Users making payments by debit card or credit card hereby agree and assure RNG that:
      1. All debit card or credit card information supplied is true, correct and complete to the best of their knowledge.
      2. The person making the payment is duly authorized to use the debit card or credit card for that purpose.
      3. The payment will be honoured by the User’s card company.
      4. The holder of the credit card is aged a minimum of eighteen years old.
    2. If the User discovers that a payment has been made on this website using their debit card or credit card details in circumstances where they had not agreed to or authorized such, then (provided they have not, through failure to take reasonable care, allowed an unauthorized person to gain access to their card details or password) RNG is required to refund to the User the money they receive provided that:
      1. The User notifies their debit card or Credit Card Company and FR of the unauthorized payment as soon as it is discovered.
      2. The User co-operates with their debit/credit card company, RNG and, if necessary the police, in relation to the unauthorized use.
      3. All payments made via RNG are final unless fraudulent use of the card is proven in accordance with clause 6.2.
    3. RNG will perform random checks of credit card users to ensure fraud prevention.
  7. Dormant Accounts
    1. For the purposes of these T&Cs, a “Dormant Account” defines any individual’s account with FR which, for twelve consecutive months or more, has not:
      1. Had any money deposits or withdrawals made.
      2. Joined a competition on FR.
    2. If FR deems that the account is in a dormant state for whatever reason then that account will be treated as dormant and be applicable to T&Cs Sections 7.3, 7.4 and 7.5.
    3. RNG reserves the right to charge both a processing fee and an annual handling fee on any funds remaining within dormant accounts.
      1. The processing fee amounts to four pounds (GBP) for each month the account remains dormant, which is deducted by FR on the first day of the following month.
      2. The annual handling fee amounts to twelve pounds (GBP) on the first day after which the account is made dormant, and another twelve pounds (GBP) one year later.
      3. These charges shall be payable in respect of any Dormant Account until such time as the account becomes active again or has a nil balance.
    4. If the remaining account balance is less than the charges applicable as per clause 7.3, that remaining amount will be deducted by FR in the same sequence as such.
    5. If an account is deemed dormant for twelve months, FR will close that account and, after the deduction of applicable fees stated in this section, any remaining funds in the account will be donated to a charity of RNG’s choice. Account closure means that if the account holder subsequently wants to enter a competition on FR, they must register and open a new account.
  8. Closing an account
    1. The User has the right to close their account at any time by sending an email requesting to do so at info@finalrunner.com. The User must be aware that until FR has consequently confirmed account closure within a reasonable period of time via email, the User will be held fully accountable for all activity on their account.
    2. Any competitions the User is currently active in will be rendered forfeited if their account is confirmed closed before the competition outcome has been decided. The User’s selection every round will be chosen by default as if they haven’t made a selection, as in the Rules of Entry. In the event that the User wins such competition, the User will be contacted via email to notify them of the winnings, after which the payment to the User will be arranged with them, paid via a payment method of RNG’s choice. If the User is not contactable or unavailable then FR will take the decision to donate any winnings to a charity of RNG’s choice.
  9. Protecting User passwords
    1. FR password protection is the User’s complete responsibility. The User is responsible for all activities that occur under their password.
    2. By accepting these T&Cs the User agrees that RNG takes no responsibility whatsoever for fraudulent use of any FR User account whereby the username and password has been used to access the account.
    3. If the User believes that their password has been compromised and/ or is being used by another person, the password should be changed immediately and they may contact RNG at info@finalrunner.com .
  10. Use of a donation
    1. The User must accept that RNG has no control over the use of donations which are made to organisations registered with this site.
    2. RNG conducts due diligence subsequent to each organisation competition conclusion, to ensure funds are used as stated on competition pages. If any organisations are found to have misused funds raised with FR, they may be suspended or permanently excluded from FR if deemed necessary by RNG after further investigation.
    3. If the User has cause for dissatisfaction with the use of their donation they may wish to contact the organisation directly using contact details provided on their FR page.
  11. Privacy and Security Policy
    1. FR’s privacy and security policies form part of the Terms of Use on this site.
    2. The User should read and understand the privacy and cookie policy fully before visiting/gambling with FR, which can be viewed using the links at the bottom of the page. The User agrees to be bound by all Terms of Use when using FR.
  12. User Conduct and Content
    1. Users must act in a legally and otherwise responsible manner when using FR. Users shall comply with all applicable laws, legislation, regulations and rules, and ensure not to use FR or allow FR to be used for any unlawful purpose, for the commission of any offence or crime under the laws of any jurisdiction to which access is obtained through the website or in a manner which is likely to cause harm, offence or nuisance to any other internet user.
    2. FR may from time to time have certain plug-ins leading from and to external third party sources such as FaceBook, Twitter and Google, and as such RNG takes no responsibility for any harmful content posted about any person or organisation through these third parties, regardless of whether they are visible on FR through that third party link.
    3. Username, profile pictures, and any other content placed on FR Services by the User may not be political, religious, contain nudity, offensive language or have any form that may be deemed offensive to others. RNG reserves the right to refuse a username or remove a picture that may be deemed as such.
  13. Links
    1. FR Services contains links to the social media channels and website(s) of the clubs, charities or bodies registered with FR.
    2. RNG accepts no liability in connection with any third party site accessed via a link from this Website, or any contract entered into or through a third party website. RNG does not provide any warranties in respect of the content of any third party websites accessed via a link from FR.
    3. Any form of relationship that the User creates with any organisation linked to FR is the User’s sole responsibility.
  14. Intellectual Property
    1. The FR name and logo are the property of RNG and may not be used in any way, shape or form by any person not representing RNG, unless they are given express written permission from RNG.
    2. The trademarks, copyright and any other intellectual property displayed to any User on FR, including names and logos of organisations and other Users registered with FR, are strictly forbidden from being used or reproduced without express written permission from RNG.
    3. The FR website contains Intellectual Property which is the proprietary property of RNG ("website IP"). The Website IP includes but is not limited to copyrights and information about technology and may be provided in the form of text, graphic, audio and video downloads, links or source codes. RNG retains the rights to the Website IP and reserves all rights in respect of same.
    4. RNG provides information on FR. Users may, for personal use only, print copies of the information and temporarily store the files on their network. Website IP is intended only for registered Users of FR and is provided only for their convenience. RNG grants no license or property rights to any such Website IP other than as expressly set out herein.
    5. The Website IP is provided by RNG on an as is basis, and RNG expressly disclaims, to the extent permitted by applicable law, any or all warranties, expressed or implied, including without limitation warranties of merchantability and fitness for a particular purpose, with respect to any Website IP. To the extent permitted by applicable law, RNG excludes any or all responsibility and /or liability for any damages or loss of any kind whatsoever with respect to the Website IP whether any of the foregoing are, without limitation, indirect, incidental, special, punitive, consequential or of any other kind whatsoever.
    6. With regard to content submitted by Users for their fundraising pages or otherwise ("user content"), RNG does not claim ownership of User Content submitted or made available for inclusion. However, with respect to User Content submitted or made available for inclusion on accessible areas of the Website, the User grants RNG a world-wide, royalty free and non-exclusive licence to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such User Content on FR solely for the purposes of providing and promoting the services provided on FR and access to the Content. This license exists only for as long as the User elects to continue to include such Content on the Website and will terminate at the time it is removed or FR removes such Content from the Website.
    7. The implications of T&Cs Section 14 also apply to any communications and any other form of FR Services, whereby any person not given written permission by RNG is strictly forbidden from using any of the said for any purpose other than in communication with FR.
  15. Changes to the Terms of Use
    1. RNG reserves the right at any time to amend or discontinue, temporarily or permanently the FR website with or without notice. The User agrees that RNG shall not be liable to them or any third party for any modification, suspension or discontinuation of FR services.
    2. Every time the site is used, the User is deemed to have understood and accepted the latest Terms of Use as published at the time.
    3. Any amendments to, withdrawal from or addition to the Terms of Use by RNG will be notified to each User via email when such are made, after which the User must accept having read and agreeing to be bound by the new Terms of Use before being able to use the site again.
  16. Failure to comply with the Terms of Use
    1. Any User who fails to comply in any way with the Terms of Use may at the sole discretion of RNG and without prior notification, be suspended or banned altogether from using FR.
    2. Before registering with FR, the User must tick a box to confirm that they have read the T&Cs laid out, agreeing to abide by and be bound by all Terms of Use presented by RNG.
  17. Termination of an account
    1. RNG may terminate a User’s FR account or a User’s use of FR on written notice (which shall include e-mail) if they are in breach of any of the Terms of Use provided by FR and fail to correct such breach within fourteen days following adequate notice from RNG specifying the breach. If the User commits what RNG deems a serious breach of FR’s Terms of Use, the User’s account with FR may be terminated effective immediately without notice.
    2. RNG reserve the right to terminate a User’s FR account if they are declared bankrupt, and in the case of an organisation, if they go into insolvent liquidation, receivership or other severe financial difficulty.
    3. In the event of the use of FR being terminated for any User, that User will still be bound by FR Terms of Use in all matters relating to FR.
  18. Limitation of Liability
    1. RNG shall use reasonable skill and care in the operation of FR. However, the User hereby acknowledges that:
      1. RNG makes no warranty as to the accuracy, reliability or currency of any information on FR.
      2. RNG shall not be liable for any interruption or suspension of FR or related services due to circumstances beyond its control including, without limitation, any breakdown in Internet connectivity or security.
      3. RNG shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the access to or use of FR, including, without limitation, damage arising as a result of any bugs, Trojan horses, viruses, worms or other harmful codes or errors experienced as a result of accessing FR.
    2. To the fullest extent permitted by applicable law, RNG shall not be liable to any User under contract, tort, equity or otherwise for any loss or damages arising out of or in connection with the User's use of FR or the provision of services by RNG, whether any of the foregoing are, without limitation, special, incidental, indirect, punitive or consequential and /or, whether any of the foregoing are, without limitation, occasioned by the negligence, fault, error, omission, act or breach of RNG, its employees, contractors or sub-contractors.
    3. Without prejudice to the generality of the foregoing, under no circumstances shall RNG be liable to any User for any consequential, economic or indirect loss or damages, loss of profits, revenue, business, capital, administrative time or loss of use of data or software, howsoever arising.
    4. RNG expressly disclaims all and shall not be deemed to have given any warranties, express or implied (by law or otherwise), other than as set out in the FR Terms of Use. RNG expressly disclaims and excludes all T&Cs, express or implied by statute or otherwise, in connection with FR, to the fullest extent permitted by applicable law. Without prejudice to the generality of the foregoing, and to the extent permitted by law all conditions and warranties implied by Section 39 of the Sale of Goods and Supply of Services Act, 1980, are hereby excluded and the parties agree that these exclusions are fair and reasonable.
    5. RNG’s maximum liability to the User for any matter arising out of or in connection with their use of FR will be limited to the aggregate of the amount legitimately owed to them in winnings and the return of the amount of the stakes of any competition on FR.
    6. The User acknowledges that RNG will hold information with respect to their identity, including, but not limited to name, address and date of birth. The User agrees that RNG relies on this information in entering into this agreement with them, and the User accepts that RNG has no liability whatsoever against any inaccuracy or falsehood contained in the information as provided by the User.
    7. User funds are protected in the event of insolvency by RNG.
  19. Indemnity
    1. The User agrees to indemnify and keep fully indemnified and hold RNG and its employees, subsidiaries, affiliates, officers and agents harmless from and against any claim or demand whatsoever made by any third party and any losses, costs, damages, expenses and liabilities, including reasonable legal fees, due to or arising out of:
      1. User Content, posts, transmits or other data made available by the User on FR.
      2. User’s use of FR.
      3. breach of the Terms of Use.
  20. Governing Law
    1. These T&Cs are governed by English law and any disputes arising in any way in relation hereto shall be subject to the exclusive jurisdiction of the Supreme Courts.
  21. Responsible Gambling
    1. RNG operates a responsible betting policy including the following:
      1. Self Exclusion: If the User wishes to restrict their playing, they can do so by following FR’s cool-off/ self-exclusion procedure in the account settings. Alternatively this facility is available by contacting info@finalrunner.com . If you would like further help with this, please access the Gambling Therapy website using the logo at the footer of the page.
      2. RNG monitors use of FR by Users to ensure and direct those believed to or may feel they have a gambling problem in the correct direction. This includes but is not limited to written communication, User account closure and enforced ‘User cool-off period’, whereby the User may not access their account on FR for between one week and three months, at the decision of RNG. This option is also available for Users to choose themselves if they feel it necessary.
    2. RNG actively assists with Gambling Care associations such as GamCare and Responsible Gambling Trust to ensure that:
      1. These options are clearly shown on the FR Home Page if Users feel the need to seek help with a gambling problem.
      2. These associations are assisted and contributed to by RNG along with the rest of the Gambling industry to ensure their continual success in helping those who want and need help with a gambling problem.
    3. Age Verification: It is illegal for anyone under the age of eighteen to open an account, to enter a competition or to gamble using any RNG products, including all FR Services. RNG takes its responsibilities in this regard very seriously. The Responsible Gambling section details the steps we undertake to ensure all players are aged eighteen or over. RNG also employs a Third Party Age Verification Service which assists to ensure that this regulation isn’t overcome.
  22. Complaints Procedure
    1. FR will do its best to resolve any complaints or disputes within twenty four hours of them being reported via info@finalrunner.co.uk. Any occurences of this sort must be reported to FR within thirty days of the event in question, and any claims received subsequently will be discarded by FR.
    2. If FR is unable to resolve a dispute related to any FR Services, RNG will refer the case to our Third Party Arbitrator, the Independent Betting Adjudication Service (IBAS), as soon as is reasonably possible.
    3. The User can make contact with IBAS via email at adjudication@IBAS-uk.co.uk. The User can fill out an adjudication form at http://www.ibas-uk.com/adjudicationForm.php, by calling IBAS on 020 7347 5883, or by writing to IBAS using the following address:

    4. IBAS’s decision will be final (save in respect of any manifest error) subject to full representation being given to all parties involved.
    5. Notwithstanding all other criteria in this section, RNG reserves the right to take legal action against any party in breach of the Terms of Use
  23. Jurisdictions
    1. With regard to persons located outside United Kingdom, they must clarify with local jurisdictional regulations and other applicable laws before choosing to become an FR User or visiting the FR site. RNG does not take any responsibility whatsoever if any potential User accesses FR without confirming the legal implications as to whether such is allowed according to local and other applicable laws.
    2. If a User joined or created a competition in United Kingdom, they must check whether jurisdictional, local and other applicable laws allow them to access FR from their location. RNG will not be responsible for Users losing out as a result of being in a location which prohibits access to FR. No refunds will be given as a result of members being in a location which prohibits access to FR during a competition. If a member is in a location which prohibits access to FR and cannot make their selections whilst there, they will be allocated the default team for the relevant round of the competition, defined in FR’s Rules of Entry.
    3. It is the User’s responsibility to fully comply with laws concerning betting in the jurisdiction in which they are located. If the User lives in a country which prohibits betting they must not register with FR, or attempt to use FR services.
    4. Accessibility of FR in any jurisdiction outside United Kingdom in a location where such is prohibited by jurisdictional, local or any other law, shall not be construed as a representation or warranty with respect to the legality of use of FR in that jurisdiction. No winnings shall be paid to the User in respect of the use of the FR whilst in a prohibited access location.
    5. RNG reserve the right to terminate the User’s account and refuse any and all current or future use of FR if suspected or know that the User has been using FR Services while in a location where such is prohibited. Users who use VPN’s (virtual private networks) may have their accounts closed or blocked if RNG suspects they are accessing the website from a restricted jurisdiction.
  24. Competition circumstances
    1. Team selection and deadlines:
      1. Players must, at latest, make their team selection 30 minutes before the start of each round In each competition in which they choose to join.
      2. In the event no selection is made before the deadline, FR will allocate a default team as that player's selection for the round. The default team is the next team available in the competition, in descending alphabetical order, not yet selected by the specific player. It will be automatically assigned in this case and can be allocated to player an unlimited number of times within a competition.
      3. Players can make selections up to 5 rounds in advance.
  25. Player team selection game postponement, delay or abandonment:
    1. If, due to circumstances out of FR’s control, fixtures have been changed, delayed or postponed, RNG holds no responsibility on the negative impact of such on the User. If such has a widespread impact, FR reserve the right to re-start a round due to such.
    2. FR will remove any matches, where postponed, delayed or abandoned, within reasonable time of finding out such.
    3. If a User selects a team from a fixture which subsequently becomes postponed, abandoned or delayed, FR will notify the User via email to amend selection if discovered more than seventy-two hours before the round selection deadline. If found within seventy-two hours of the deadline, any players that have already selected a team involved will receive a bye into the next round, but will not be able to make that selection again in the corresponding competition(s).
    4. If the User is sent an email prompt to amend their selection as a result of a game postponement, delay or abandonment, failing to do so before the competition deadline for that round will result in the User being allocated the default team for that round.
    5. If a drastic and late change in fixture schedule occurs, due to any occurrence out of FR’s control, FR reserve the right to cancel a round, which means the players in that round all continue onto the next round of fixtures. This will only be done if FR deems this negative impact to be widespread across Users.
    6. If a competition is still in progress when the league(s) chosen for it have reached the end of their sporting season, FR will generally close it, which will result in all remaining players evenly splitting the available cash prize. If a competition has some form of non-monetary winners' prize available, FR will contact all remaining players to explain the outcome, as deemed fair and unbiased by RNG.
    7. If a competition ends with more than one player still remaining, the cash prize will be evenly split between them.
  26. Promotions & Features
    1. The User is allowed to ‘Add Players’ to a competition, which means that those additional entries will be paid for by the User on behalf of others for whom they have entered the competition. The maximum number of players a User can add using this function is 10 (ten). The following apply to such:
      1. The User will manage the selections for those additional entries using their FR account. Responsibility for making the correct selection lies between the User and the person they have entered the competition for. FR will refuse any responsibility for any claims/ disputes regarding such, and as a result will not amend such selections once deadline for the relevant rounds have been reached.
      2. If any of the additional entries win the competition, the winnings will be allocated to the User’s account. It is between the User and the entrant to ensure the money is allocated to the entrant. FR refuses any responsibility for any claims/ disputes regarding money not being paid or any other dispute relating to additional entrant’s winnings.
    2. The following define the 'buy back' feature, which is only available in competitions where it has been selected by the creator:
      1. The amount a player must pay to regain entry to a competition via Buy Back will be shown on the competition page below the player league table (as clearly labelled below the button, round two must be selected to exercise the feature).
      2. The Buy Back amount is based on a generic formula created by FR, and varies dependent on certain factors to ensure fairness for Users who progressed and therefore didn’t exercise their Buy-Back option.
      3. This feature is only available to the User if they get knocked out of a competition in the first round. If a User progresses beyond the first round of the competition, the Buy Back feature is no longer available.
      4. The Buy Back feature is only available to exercise before the round two deadline in a competition. If the round two deadline is reached or a player isn't knocked out in round one, the feature will no longer be available in the competition.
      5. The buy back amount is subject to the administration fee referred to in section 2.1, with the remaining amount added to the cash prize pot available to the competition winner(s).
      6. After exercising the Buy Back feature, a User does not have access to that function again in that competition.
      7. The extra funds paid into the competition as a result of Users exercising their Buy-Back option will be subject to the fees discussed in T&Cs Section 2.1.
    3. The following define the 'split pot' feature, which is only available in competitions where it has been selected by the creator:
      1. This feature is available to select throughout the competition. Players can choose to opt in/out any number of times and at any time except when a round is closed.
      2. The User will be given the option to opt in to split the pot, found on the ‘View Competition’ page. The pot will only be split once all remaining Users in that competition have opted in to split the pot, otherwise the competition will continue until either all Users have selected ‘Split Pot’ or there is a winner.
      3. The User can amend their ‘Split Pot’ decision up until the time when all other Users have agreed to split the pot.
      4. A summary below the player league table, on the competition page, will show the number of players that have currently selected split pot, as well as the amount each player were to win if split pot were to be exercised before the next round deadline.
      5. If all remaining players simultaneously opt to split the pot at any point in the competition, it will be closed and the cash prize will be evenly split between them, with funds allocated to their respective E-Wallets.
    4. The following define the ‘double chance’ feature, which is only available in competitions where it has been selected by the creator:
      1. This option must be selected before the deadline for the round in question has been reached, by clicking the button below the player league table on the competition page before selecting teams.
      2. Players can make two selections in one round of their choice. If both or one of the selections wins the player progresses to the next round, but neither can be selected by the player again in the competition. If both lose, the player exits the competition.
      3. Each player can only use this feature once in a competition.
    5. The following define the 'draw no lose' feature, which is only available in competitions where it has been selected by the creator:
      1. This option must be selected before the deadline for the round in question has been reached, by clicking the button below the player league table on the competition page before making the selection.
      2. Players can choose a team they think won't lose in one round of their choice. If the selection wins or draws, the player progresses to the next round of the competition. If the selection loses, the player exits the competition.
      3. Each player can only use this feature once in a competition.
    6. The following define the 'sympathy loser' feature, which is only available in competitions where it has been selected by the creator:
      1. This feature does not need to be selected by the player. It triggers once the criteria is met.
      2. Players will be granted a bye into the next round if their selection loses by three or more goals. If a team loses by two or more goals, any players who had selected them exit the competition.
      3. This feature can only be triggered once. If a player's selection loses by three or more goals, they are given a bye. If their selection loses by three or more goals in the competition again, they exit the competition.
    7. With regards to any competitions which have been made available for free User entry by FR, the following apply:
      1. Free entry can only be attained by entering an FR-issued unique code into the 'promotion code' entry box on the User dashboard. If a player without the code would like to enter, there will be an entry fee, which is decided upon by FR on creating the competition. Any payable entry fees will not enhance the prize available to the competition winner(s).
      2. The promo code issued for entry to these competitions will have a set start and end date - FR will define when to start promoting each code, how long each will be promoted for, the cash prize available to the winner and how to pay the eventual winner.
      3. Each unique code issued by FR is only valid for use in one competition.
      4. FR reserves the right to withdraw the free entry if deemed necessary.
